This privacy policy (the “Privacy Policy”) sets out the privacy policies and practices for Tech Stack Playbook® & Brian H. Hough, LLC and its subsidiaries and affiliates with respect to how we collect your personal information. It also describes how we maintain, use, and disclose personal information. This Privacy Policy applies to information collected from you by us via this website, https://www.techstackplaybook.com, and other websites operated or provided by us and various subdomains (collectively, the “Sites”) and other places where we may collect personal information like industry or networking and online events.
This Privacy Policy also sets out how you can access certain information that we may collect about you. In this Privacy Policy, “personal information” means information or opinions about an individual whose identity is apparent or can be reasonably ascertained from the information or opinion as further defined under applicable privacy laws.

We reserve the right, in our discretion, to change, modify, add or remove portions of this Privacy Policy at any time and from time to time, without prior notice to you. However, we will treat your continued use of the Sites following such revision as your acceptance of the revised terms. What personal information do we collect and how is it processed?
- What do we collect? We collect your name, e-mail address, contact information, and any information you choose to share with us as answers to questions our forms have.
- Newsletter. We will ask for both your name and e-mail address in order to send you our newsletter or e-mails through Kajabi. We will only contact you through our newsletter for promotional or informational purposes.
- Third Parties. We may work with third party applications in order to provide you with the best services on the Site. These organizations may collect personal information from you in order to provide you with these services including your name and contact information. - How will we use your personal information? Your personal information will be used to provide you with promotional and informative materials and offer and deliver the products and services you can purchase or subscribe to from the Site. Specifically:
- Your name and e-mail address are collected but will not actually be stored on the Site. Any information captured will be processed through third party websites in section 4.c above.
- If you subscribe to our newsletter your information will be used to send the newsletter to you;
- If we send you the Newsletter for marketing purposes, we may use your contact information to send you e-mails about promotions, special events and other marketing information. You can opt not to receive these e-mails from us by either clicking “unsubscribe” at the bottom of the e-mail when you receive it or by sending an e-mail that includes your e-mail address and a request that you not receive our promotional e-mails; and
- We may use your personal information to respond when you submit a question or suggestion to us, or when you request assistance with the service you purchased.
- Storing Your Personal Information. Our web server may store your personal information when you interact on the Site. We will be happy to delete any of your information it holds upon request made by you. Your personal information will be safely disposed of by us by deleting it from its possession.
- United States Law. The Site and our organization abide by all relevant United States laws in all aspects of our operations.
- International Data: Our website is hosted by servers located in the U.S.
- Therefore, if you reside in the European Union, some of your data will be transferred internationally to those servers. Data Retention: We retain personal data as long as it is needed to to conduct our legitimate business purposes or to comply with our legal obligations, or until you ask us to delete your data. For example, we will retain certain personal information indefinitely for the purposes of maintaining your account, unless and until you delete your account. Data that we gather for a specific and particular purpose, such as assisting law enforcement or analyzing trends, will not be kept for longer than is necessary for that particular purpose. Data that is no longer needed by us for any of the purposes listed above will be permanently deleted. You may request that we delete your data at any time. However, note that we cannot control the retention policies of third parties. If you wish to have any third parties, including those to whom we’ve transmitted your data, delete that data, you will need to contact those third parties directly. You may request from us a list of all third parties to whom we have transmitted your data.

Right to Delete. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies.

- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Exercising Your Rights to Know or Delete. To exercise your rights to know or delete described above, please submit a request by emailing us at [email protected]. Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may only submit a request to know twice within a 12-month period.

You do not need to create an account with us to submit a request to know or delete.

We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.

Response Timing and Format. We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact [email protected]. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
- California Residents: This Privacy Policy for California Residents supplements the information contained in this Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this Policy. Where noted in this Policy, the CCPA temporarily exempts personal information reflecting a written or verbal business-to-business communication (“B2B personal information“) from some of its requirements.

As of its effective date of January 1, 2020 We are also compliant with the California Consumer Privacy Act Of 2018, Cal. Civ. Code §§ 1798.100 Et Seq. (CCPA). Any California resident may request, free of charge, the personal information We have collected or stored about themselves or about a member of their household. For security purposes, We reserve the right to ask for verification of Your identity and proof of your California residency at the time of your request.

California residents also have the option to request a full deletion of their account and any data We have collected and associated with them.

We agree to comply with any data request or deletion made pursuant to the CCPA in a reasonable timeframe, during normal business hours and excluding holidays or Our pre-scheduled time off.

- Children. This website, resources, services, or mobile app are not designed for use by children under age 16, and we do not knowingly solicit personal data from anyone under age 16. If you are under age 16, do not access or use our website or related products or services. If you become aware that we have collected data of anyone under the age of 16, please contact us so that we may delete that data.
- Do Not Track Signals. We currently do not recognize or respond to browser-initiated Do Not Track (DNT) signals, as the Internet industry is currently still working on Do Not Track standards and there is no accepted standard on how to respond to such signals.
- Analytics. The Site does keep the following information from your visits to our webpage:
- Visitor information to improve our customer engagement which tells us where and when people visit the Site and how long they stay there; and
- IP information for website and server security
- Cookies. The Site does use ‘cookies’ to keep a record of the number of times you’ve visited the Site and how you interacted with the Site during each visit. In addition to this, the Site also uses cookies which are not absolutely essential for your use of the Site. Your continued use of the Site does serve as consent for these cookies.
- You might be wondering what a cookie is? Well, it is a small text file that gets sent by the server of the Site to your hard drive and can only be read and interpreted by the Site’s server. No personal information is stored in the cookie and there is nothing on it which can identify you personally.
- Why do we use cookies? Despite being an awesome word generally, cookies help the Site understand how you interact while visiting the Site, what your preferences are and thus can improve your experience on the Site. - Jurisdiction. This privacy policy and the use of the Site are governed by the laws of the Commonwealth of Massachusetts. If a dispute arises under this policy, we agree to first resolve it with the help of a mutually agreed-upon mediator in the Commonwealth of Massachusetts.
- Your Consent. By choosing to provide us with your personal information you are consenting to its collection, use and disclosure in accordance with the principles outlined in this Privacy Policy. If you are under the age of 18, you must not provide any personal information to us without the consent of your parent or guardian, or as otherwise provided for by applicable law. This Privacy Policy may be updated from time-to-time and your subsequent use of our web site will be accepted as consent to the collection, use and disclosure of your information as set out in this Privacy Policy.
- Protecting Your Privacy. We are committed to protecting your privacy. Security measures, such as locked filing cabinets and the use of passwords on e-mail servers and unique passwords to access phones have been adopted to protect your personal information against loss or theft, unauthorized access, disclosure, copying, use or modification. We make no promises, warranties or representations about the manner in which your personal information is handled by Third Parties and bears no liability whatsoever for your use of them.
- The Internet Can Be Unpredictable. The internet is, by its nature, inherently open and subject to interception of information. We cannot guarantee that the information you provide to us over the internet or otherwise will not be intercepted by third parties while it is being communicated by means that are outside of our control.
- Verifying and Amending Your Personal Information. We try to ensure that all personal information about you that is in our possession is accurate, complete and up-to-date.
